By signing up and actively using the duckhousemail.com program you agree to all terms and conditions
set forth in this agreement. duckhousemail.com may, at any time, choose to edit, add and/or delete
portions of this agreement and impose changes without prior notification of its
members. Members will be informed of any and all changes to this policy via an
email to their primary contact email address provided upon signing up with duckhousemail.com and/or a global administrative message that requires a response to show that it has been read.
If any modification is unacceptable to you, your only recourse is to terminate
this agreement. Your continued participation in the duckhousemail.com program following our posting
of a change in policy notice or new agreement on our site will constitute binding
acceptance to the change.
Responsibility of Members:
You must be 16 years of age or older to participate in this program. Our program
is open to both US and International members and is void where prohibited by state and/or local governing laws. As of March 5, 2007, persons from China(including Taiwan), Iran, Iraq, India, Poland, Ukraine, and the Russian Federation are prohibited from signing up here at Duckhouse Mail.
You agree to and must use your own name and email address in the sign-up process
and may not assume a false identity. You may not sign-up multiple times with different
email addresses. Any member using an aol.com email address MUST have their email setting set to onsite inbox only or you will be deleted. Your computer must not be shared with another individual that
has an existing duckhousemail.com account, unless otherwise cleared with webmaster
You will use your email address / password combination to access your account,
it is your responsibility to keep this information confidential, you may change
this information by logging into your account and following the "User Account
Info." link. Selecting less than three(3) keywords or selecting ANY bad keywords will result in immediate termination.
You are solely responsible for any and all use of your duckhousemail.com account including authorization
by you to any third party individual who may use your account.
Should any instances of fraud, system abuse, or any type of activity deemed to
be inappropriate or illegal by duckhousemail.com be detected it may result in member termination
and possible legal action. Any solicitation of advertisers for a confirmation
email for purposes of receiving credit in your account will be grounds for immediate
termination.
You must maintain your email account that you used when signing up duckhousemail.com. You agree
to receive e-mail advertising from duckhousemail.com. limited to no more than (15) per day.
In the event your e-mail account on file becomes closed or blocked to messages from duckhousemail.com, your account will be set to inbox only. Should you keep changing your account back to email only or email and inbox and it is again returned or blocked, your account will be terminated unless you have contacted me and we are working on resolving the problem. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish which includes emails that are NOT in English, will result in automatic termination of account and Forfeiture of All earnings to date of termination.
Auto-responses will also be deleted immediately.
Relationship of the Parties:
You and duckhousemail.com are independent contractors, and nothing in this Agreement creates
any partnership, joint venture, agency, franchise, sales representative or employment
relationship between you and duckhousemail.com. You understand that you do not have authority
to make or accept any offers or make any representations on behalf of duckhousemail.com. You
may not make any statement, whether on your site or otherwise, that would contradict
anything in this section. You are solely responsible for the reporting and payment
of any taxes for money earned while using the program.
Limitation of Liability:
duckhousemail.com will not be liable for lost profits, lost business opportunities, or any other
indirect, special, punitive, incidental or consequential damages arising out of
or related to this Agreement or duckhousemail.com program, even if duckhousemail.com has been advised of the
possibility of such damages. Furthermore, duckhousemail.com aggregate liability arising under
this Agreement will not exceed the amount of the total fees paid or payable to
you under this Agreement. The provisions of this Section survive termination or
expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites
after they have entered their member ID in the area on the website provided by
duckhousemail.com. Members may earn by referring new members to the duckhousemail.com program. Members will
earn a percentage of advertising revenues collected by duckhousemail.com. Members will be paid
via PayPal,GPT-Pal, or redemption for ads. Duckhousemail.com will pay members when their balance reaches the minimum
payout rate set by duckhousemail.com. All members must have $2.00 in personal earnings before payout will be granted. Once the member has reached payout they may request payment.
Payout is set at $3.50. 10% of all payouts will be deducted from members total payout amount and put into the charity fund...when the charity fund reaches $20.00, members will receive a copy of the receipt showing amount and charity funded.
PERSONS FROM CHINA(INCLUDING TAIWAN), IRAN, IRAQ, INDIA, POLAND, UKRAINE, AND THE RUSSIAN FEDERATION ARE NOT ALLOWED TO SIGN UP. Those from the countries listed above whom signed up before March 5, 2007 may redeem for ads only. Payment information MUST be set to "ad redemptions" and the payment ID box MUST be left blank. Failure to comply will result in immediate termination.
Also note that you may NOT share a payment account with someone else. The name on your payment processor MUST match the name on your Duckhouse account. Special exceptions to this rule will be considered as long as you contact us with complete details of the circumstances and receive approval PRIOR to listing a shared payment account. Failure to comply will result in immediate termination. Payments will be made within 30 days or a reasonable time after.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to comply
will result in immediate termination of your membership with duckhousemail.com and may result
in legal prosecution. duckhousemail.com strictly enforces anti-Spamming laws. Spamming is a federal
crime. Any member caught Spamming will not only have their account terminated
immediately and lose any past, present and future earnings, but shall also be
held liable for Spamming as we shall cooperate with any authorities and investigations
that may arise from the Spamming incident. duckhousemail.com may charge up to $5 per spam email
sent. Multiple sign-ups shall be grounds for immediate termination of all involved
accounts. Signing up multiple times from the same computer also constitutes fraud.
duckhousemail.com will file charges for recovery of any earnings received from multiple sign-ups.
